- You must file an annual report with EPA if you operate an establishment that produces:
- a pesticide
- an active ingredient
- a pesticidal device
- Products also requiring reporting include, but are not limited to, the following:
- unregistered pesticides
- Experimental Use Permits
- Special Local Need products under § 24(c) of Federal Insecticide, Fungicide and Rodenticide Act (FIFRA)
- pesticides produced for export only
- ozone or ultraviolet light producing devices for disinfecting
If your establishment did not produce or distribute products subject to FIFRA Section 7, you still must file a zero production report with the Agency.
2. What if I produce other types of products?
Other types of products which you produce should not be reported. For example, a company may produce a "weed and feed" product (an herbicide/fertilizer mixture) that is registered as a pesticide as well as a fertilizer-only product. The fertilizer product should not be reported. The herbicide/fertilizer registered product must be reported.
Each producer operating an establishment must submit the following information for each product produced at the establishment:
- types and amounts produced in the past calendar year
- types and amounts sold/distributed in the past calendar year, regardless of when the product was produced
- an estimate of the amount expected to be produced in the current year
4. If I close an establishment, what should I report?
Enter all production and distribution information for the current year on the establishment report form (PDF). (335K, 1 page, About PDF) If there was no production, check the box in block 14 of the the report form where it states “Did Not Produce/Distribute.”
State on the report that the company/establishment is no longer in business, and if it produced or did not produce.
5. How do I inactivate my establishment number?
To inactivate your establishment registration number, please include your company's request for inactivation on company letterhead and send it to the appropriate pesticide establishment coordinator along with your final production report as described in question 4.
6. What if I produce a fraction of a unit?
Please round all numbers to the nearest whole number.
7. What if I do not receive an annual report form from EPA?
While the Agency mails the pesticide annual report form (PDF) (335K, 1 page, About PDF) (EPA Form 3540-16) to all registered establishments at the end of each year to assist them in fulfilling their reporting obligations, the reporting requirement is not waived if the mailing does not reach your company. It is your company’s responsibility to report production amounts annually.
8. What if I fail to file this production report?
Failure to file an initial or annual production report is a violation of FIFRA, and may result in termination of the establishment’s registration, civil penalties up to $6,500 per violation and/or criminal penalties. In addition, it is unlawful to knowingly falsify all or part of any pesticide production information reported on EPA Form 3540-16 (PDF). (335K, 1 page, About PDF)
