Information on the
United States v. Microsoft Settlement
On November 6, 2001, the United States and Microsoft tentatively agreed
to the entry of a revised proposed Final Judgment
to resolve the United States' civil antitrust case against Microsoft.

Tunney Act
(Antitrust Procedures and Penalties Act, 15 U.S.C. § 16)
The Tunney Act sets forth procedures that must be followed whenever the
United States proposes to settle a civil antitrust suit through entry
of a consent decree. Pursuant to the Tunney Act, members of the public
have an opportunity to comment on the proposed settlement
before it is accepted by the court.
The Tunney Act procedures require the United States to:
- File a proposed Final Judgment and a Competitive Impact Statement
(CIS) with the court.
- Publish the proposed Final Judgment and CIS in the Federal Register.
- Publish notice of the proposed Final Judgment in selected newspapers.
- Accept comments from the public for a period of 60 days after the
proposed Final Judgment is published in the Federal Register.
- Publish the comments received, along with responses to them, in the
Federal Register.
- File the comments received and responses to them with the court.
The United States reserves the right to withdraw its consent to the revised
proposed Final Judgment at any time prior to its acceptance by the
court. After receiving the comments and the United States' response, the
court may enter the revised proposed Final Judgment if it is found to
be in the public interest.

Pursuant to the Tunney Act, the period for public comment ends January
28, 2002.
