District Attorneys
The State of Colorado does NOT license or register employment agencies; however, certain state laws do apply. Enforcement is only handled by local District Attorney, Consumer Affairs Section in the appropriate county. To file a complaint, contact the local office. Employment agencies are not required to register or obtain a license with the D.A.'s office. (Fraudulent and Deceptive Sales and Business Practices, 18-5-307, C.R.S.)
Any fee paid by an applicant to a private employment agency shall be by written contract, including specific provisions for refunds and extended payment options.
No fee shall be charged by a private employment agency until an applicant is placed in employment.
If employment terminates, for any reason within 100 days, an applicant shall NOT be required to pay a fee to the agency in excess of 1% of the total fee for each calendar day elapsed between the beginning and termination of employment. The total fee shall be based on the actual gross income earned annualized in accordance with the contract fee schedule.
If the employee is terminated within 100 days, the employer MUST refund any coverage after figuring correct fee (see #3) within 7 days.
If the refund is not made within 7 days, the agency is liable to the applicant PLUS the additional sum equal to the amount of the refund.
If the agency or any of its employees violates the law there are penalties detailed in the Consumer Protection Act.
It is unlawful for any private employment agency to knowingly send an applicant to any place where a strike or lockout exists or is impending without notifying the applicant of the circumstances.
Also includes businesses that provide lists of potential employees or available jobs where applicants are charged at least $20 for access to lists within a 30-day period.

It is illegal for an employment agency to discriminate on the basis of race, religion, color, creed, disability (mental and physical), national origin, sex, age, or marriage to a co-worker.
Employment agencies must post an official anti-discrimination poster in a conspicuous place.

No employment agency shall suggest or require that applicants submit their photographs prior to their employment or placement, unless the requirement is based upon a bona fide occupational qualification.
