Must apply at least 30 days prior to making any sales.
Must comply with local zoning and fire codes, and local fireworks permit, if any.
The types of fireworks which are permissible for use in Colorado are specified by Colorado law. In general, sparklers, fountains, ground spinners, and novelty fireworks items that do not have a report (explode) or are not intended to leave the ground and fly through the air, are permissible for use in Colorado. Fireworks items such as firecrackers, rockets (including bottle rockets), mortars and the like are not legal anywhere in Colorado.

The fireworks manufacturing process may release chemical and solvent emissions into the air.
If the emissions are above specified levels, Air Pollution Emission Notice (APEN) is required. $119.96 filing fee, $59.98/hr evaluation fee. Requires final approval and ongoing inspections Annual fee based on emissions.
All fireworks manufacturers should contact the Technical Assistance Program to determine if they are subject to APEN requirements.

If your business is seasonal and you make retail sales during only part of each year, you must obtain a standard sales tax license. When you apply for your license, indicate on the "Colorado Business Registration" (CR 0100) which months of the year your retail business will be active. The department will send you returns only for those months during which you do business. The return is due on the 20th of the month following the reporting month. If your seasonal business is conducted in several locations, you must have a separate license for each location. See FYI Sales 9, Sales Tax Licenses.

Local Licensing Authorities
Local authorities typically regulate fireworks, and can further restrict the types of fireworks that can be sold or used and can ban fireworks sales and use outright.
