The Arbitrator denied the grievance which alleged that the Agency improperly imposed a one-day suspension on the grievant. The Authority denied the Union's exceptions and concluded that the award was not contrary to law.
The Authority found that the grievant's due process rights were satisfied when he was afforded an opportunity to, and did, orally respond to the charges against him. The Authority also held that the award did not fail to draw its essence from the parties' agreement, that the Arbitrator did not exceed his authority, nor failed to provide a fair hearing, or that it was based on a nonfact.
