The Arbitrator denied the grievance and found that the Agency did not violate Article 37 of the parties' agreement when it refused to broadcast a Union announcement. The Authority denied the Agency's exceptions. The Authority found that the arbitrator did not exceed his Authority an that the award was based on a nonfact.
