Appeals

A person whose initial FOIA request for records is denied, either in whole or in part, or whose request for a waiver of fees has been denied, has the right to appeal the denial to the FDIC's General Counsel (or designee) within 30 business days after receipt of notification of the denial.

Appeals must be in writing and include any additional information relevant to consideration of the appeal. Appeals should be sent: through the U.S. mail addressed to the FDIC, Legal Division, FOIA/PA Group, 550 17th Street, N.W., Washington, DC 20429; via FAX to (202) 898-6910; or via e-mail to efoia@fdic.gov. The FDIC will notify the appellant of the disposition of the appeal within 20 business days after receipt of the appeal. A denial of an appeal for records will generally be based on the exemptions described in the exemption information web page.

Notifications for a denial of an appeal will be in writing and will state:

Whether the denial is in part or in whole;

The name and title of each person responsible for the denial (if other than the person signing the notification);

The exemptions relied upon for the denial in the case of initial requests for records; and

The right to judicial review of the denial under the FOIA.
