  • Announcement

Effective December 31, 2001, required trust information has been incorporated into the Reports of Condition and Income, in Schedule RC-T - Fiduciary and Related Services. All banks that exercise fiduciary powers and have fiduciary assets or accounts will provide this information in their December Call Reports. Then, commencing in 2002, institutions with trust departments meeting specified size criteria must also complete certain segments of Schedule RC-T in their March, June, and September Call Reports.

Beginning with year-end 2001, trust information for individual institutions will be available at the Call and Thrift Financial Reports web site, http://www2.fdic.gov/Call_TFR_Rpts. Trust information for individual institutions filed annually from year-end 1997 through year-end 2000, will continue to be available at the Trust Institutions Information site, http://www2.fdic.gov/structur/trust.

    Notice

The Annual Report of Trust Assets (FFIEC Form 001) and the Annual Report of International Fiduciary Activities (FFIEC Form 006) are no longer being utilized as required report forms. For the first time, effective for year-end 2001 trust reporting by banks, there is a new format that is being introduced.

Trust reporting is now a part of the bank's quarterly financial reporting requirement set forth by the FFIEC. The quarterly report is the Consolidated Reports of Condition and Income, generally known as the Call Report. A new schedule, Schedule RC-T, Fiduciary and Related Services, was added to the Call Report to collect information on trust activities that was previously incorporated in the Annual Report of Trust Assets and the Annual Report of International Fiduciary Activities.

Every national bank, state member bank, and insured state non-member bank should continue to file their respective Call Reports, including Schedule RC-T.

Trust activities of institutions that are non-insured state-chartered trust companies will or will not be reported in Schedule RC-T, depending on the form of the trust company's ownership:

    • If the trust company is owned directly by a holding company (or by a nonbank subsidiary of a holding company),

The trust company no longer has a federal report to file. There is no required reporting of trust activities because a bank does not own or control the trust company in this situation.

However, individual state banking departments may have their own reporting requirements for trust activities.

    • If the trust company is owned directly by a FDIC-insured bank, the subsidiary trust operation should be consolidated with the parent bank according to the consolidation requirements found on page 8 of the General Instructions of the Instructions for Preparation of Consolidated Reports of Condition and Income.

There are three major changes you should be aware of, as follows:

    • Due Date - The Schedule RC-T must be filed (with the bank's overall Call Report) not later than January 30th (except for certain banks with foreign offices, for which the Call Report, including Schedule RC-T, is due February 14th). Previously, the Annual Report of Trust Assets was not due until February 15th, and could be extended to March 15th.
    • Format - The new Schedule RC-T differs somewhat in scope and format from its predecessor. Information has been added, dropped, or changed.
    • Electronic Filing Requirement - The Call Report, including Schedule RC-T, must be submitted electronically. The bank should already have the software package in place for the Call Report. Whoever completes/files the Call Report for the bank will also have to input the trust data for Schedule RC-T.

The forms and instructions for Schedule RC-T are available on the FDIC's and the FFIEC's web sites. Forms are available within the general Call Report form at http://www.fdic.gov/regulations/resources/call/index.html (FDIC's) and http://www.ffiec.gov/PDF/FFIEC_forms/FFIEC041_200103.pdf and http://www.ffiec.gov/PDF/FFIEC_forms/FFIEC031_200112.pdf (click on the Schedule RC-T link at the bottom of the navigation bar on the left of the screen) (FFIEC's). The instructions are available at http://www.fdic.gov/regulations/resources/call/index.html and http://www.ffiec.gov/PDF/FFIEC_forms/FFIEC031_041inst_RC_T200003.pdf, respectively.

You should also read the banking agencies' Financial Institution Letter (FIL-104-2001, dated 12-14-2001), which elaborates key features of the December Call Report, as well as the Supplemental Instructions included in the FIL. Both have information you may need for completing Schedule RC-T. The FIL is available on the FDIC's web site at http://www.fdic.gov/news/news/inactivefinancial/2001/fil01104.html and the Supplemental Instructions are at http://www.fdic.gov/news/news/inactivefinancial/2001/fil01104a.html.

The Supplemental Instructions are especially important if the bank operates any common trust funds for personal trust accounts.
