Discovery


During the Discovery period of a case, trial staff may gather information through several methods:

  1. Data Request;
  2. Depositions;
  3. Inspections;
  4. Interrogatories;
  5. Staff on-site audits; and
  6. Subpoena.

Privileged Information

During discovery, there may be situations where a party objects to providing documents or other material to the other parties in the proceeding, on the ground that such material is privileged.

The Commission's Rules of Practice and Procedure permits the presiding judge to issue a protective order PDF. The protective order preserves the privileged status of the information, but at the same time, makes it available to the other parties to assist them in preparing their case.
