The Office of Administrative Hearings is responsible for conducting administrative hearings and issuing recommended or final decisions for all divisions within the Department of Commerce and Consumer Affairs that are required to provide contested case hearings pursuant to the provisions of Hawai`i Revised Statutes Chapters 91 and 92.

Additional matters heard by the Office of Administrative Hearings include: 1) medical tort claims under the provisions of Hawaii Revised Statutes §671-11 et seq. (the Medical Claims Conciliation Panel); 2) tort claims against design professionals under the provisions of Hawaii Revised Statutes Chapter 672B (the Design Claim Conciliation Panel); 3) disputes arising from the State's procurement laws pursuant to Hawai`i Revised Statutes Chapter 103D; 4) due process hearings involving the Individuals With Disabilities Education Act (IDEA) and the Department of Education, State of Hawai`i; and 5) certain kinds of condominium disputes under the provisions of Hawaii Revised Statutes §§514A-121.5 and 514B-161 (Condominium Dispute Resolution Pilot Program and the Condominium Management Dispute Resolution Process Pilot Program).
