About EAR

These regulations are issued by the United States Department of Commerce, Bureau of Industry & Security (BIS) under laws relating to the control of certain exports, reexports, and activities. In addition, the EAR implement antiboycott law provisions requiring regulations to prohibit specified conduct by United States persons that has the effect of furthering or supporting boycotts fostered or imposed by a country against a country friendly to United States.

The export control provisions of the EAR are intended to serve the national security, foreign policy, nonproliferation, and short supply interests of the United States and, in some cases, to carry out its international obligations. Some controls are designed to restrict access to dual use items by countries or persons that might apply such items to uses inimical to U.S. interests. The EAR offers authoritative guidance on issues such as:

  • When is an export license necessary and when is it not?
  • How do you obtain an export license?
  • What policies are followed in considering license applications?
  • How do you know when the policies change?
  • What are the latest restrictions on exports to certain countries and certain types of goods and services?
  • Where are restrictive trade practices and boycotts prohibited?

Online Web Database

These lists are:

  • Debarred Parties – Parties denied export privileges under the International Traffic in Arms Regulations (ITAR) as administered by the Office of Defense Trade Control (DTC).
  • Denied Persons List – Parties denied export privileges as administered by the Bureau of Industry and Security. The list may be found in the Export Administration Regulations, 15 CFR Part 764 Supplement No. 2.
  • Entity List - Entities subject to license requirements because of their proliferation of weapons of mass destruction. The list may be found in the Export Administration Regulations, 15 CFR Part 774 Supplement No. 4.
  • Specially Designated Nationals, Terrorists, Narcotics Traffickers, Blocked Persons and Vessels - Parties subject to various economic sanctioned programs administered by the Office of Foreign Assets Control (OFAC).
  • Unverified List - "Red Flags," parties to past export transactions where checks could not be conducted or end user could not be verified.
  • General Order No. 3 - (vacant and reserved at present)

NTIS notifies you by e-mail each time BIS updates the EAR or any of the prohibited parties lists is updated. This service is advised for subscribers to the CD-ROM or paper copy EAR who otherwise won't learn of changes to the EAR until the next quarterly update.
