Box 2000 Frankfort, Kentucky 40602-2000 Re: Complaint Number XX Dear Mr. Ransdell: This letter is in reference to the complaint filed with our office alleging that the Madison County District Court did not provide Ms. XX with an interpreter during her arraignment on XX in violation of title II of the Americans with Disabilities Act of 1990 (ADA). We have received information from you indicating that Madison County has developed a policy to designate the Circuit and District Court Clerk's Office as the responsible entity for "maintaining a calendar for the tracking of all legal matters pending in the Madison County Circuit and District Courts in which special accommodations or assistance is needed." The policy also requires the Clerk's Office to take any additional steps to insure compliance with title II of the ADA, including, but not limited to, securing the attendance of sign language interpreters for hearing impaired individuals. Based on the foregoing information, we have concluded that the allegations against the Madison County District Court have been resolved. Please note that, if the complainant is dissatisfied with our determination, she may he entitled to file a private complaint in the United States District Court under title II of the ADA. This letter does not address other potential claims of discrimination on the basis of disability that may arise from the activities of the Madison County District Court.
