Hydropower - Compliance and Administration
Jurisdiction Determination
Section 23(b)(1) of the Federal Power Act requires an entity to
either file a hydropower license application for a proposed project
or file a Declaration of Intention with the Commission to determine
if the proposed project requires licensing. If the hydropower project
is operating, the operator should file a Petition for Declaratory
Order.
The following guide and regulation are provided below to assist
you in filing your Declaration of Intention or Petition for Declaratory
Order.
Please submit an original and 8 copies of your Declaration of Intention
or Petition for Declaratory Order with the:
