Copyright Office Announces Proposed Settlement for Adjustment of Cable Statutory License Royalty Rates; Requests Comments and Notices of Intent to Participate

The Copyright Office is submitting for public comment a settlement proposal for the adjustment of certain royalty rates for the use of the cable statutory license. The agreement proposes amending the basic royalty rates and the gross receipts limitations, the regulations governing the filing of the statements of account to reflect these changes, and proposes that these changes become effective beginning with the second semiannual accounting period of 2005. Any party who wishes to challenge these proposed amendments must submit its written comments to the Librarian of Congress no later than close of business on August 19. In addition, any party submitting written challenges must also submit an accompanying Notice of Intent to Participate in a Copyright Arbitration Royalty Panel (CARP) proceeding to adjust the cable rates and gross receipts limitations. Anyone who challenges the proposed rates must be willing to participate fully in a CARP proceeding and have a significant interest in the adjustment of the rates.
