No. 00-0261/MC. U.S. v. Raymond S. ARMENDARIZ. CCA 98-1735. On consideration of the granted issue in this case, 53 MJ 434, we hold that appellant has failed to persuade us that the military judge in this case committed plain error when he allowed the Government to introduce evidence which bolstered the credibility of the two victims of the alleged assaults during rebuttal. See United States v. Schlamer, 52 MJ 80, 85-86 (1999). Accordingly, it is ordered that the decision of the United States Navy-Marine Corps Court of Criminal Appeals is affirmed. Judge BAKER did not participate in this decision.

WHETHER THE MILITARY JUDGE WAS DISQUALIFIED UNDER ARTICLE 26(b), UCMJ, BECAUSE HIS UTAH LICENSE TO PRACTICE LAW WAS IN AN INACTIVE STATUS AT THE TIME OF APPELLANT’S COURT-MARTIAL WHICH CONSTITUTES A JURISDICTIONAL DEFECT IN THE PROCEEDINGS, VIOLATES AIR FORCE INSTRUCTION 51-103, AND CONTRAVENES AN 8 MAY 1997 TJAG LETTER. It further appearing that the issue was not raised before the United States Air Force Court of Criminal Appeals, it is further ordered that the record of trial is hereby returned to that court for further review in light of the question of the qualifications of the military judge. Thereafter, Article 67(a), Uniform Code of Military Justice, 10 USC § 867(a)(1994), shall apply.

WHETHER THE SPECIAL COURT-MARTIAL CONVENING AUTHORITY WAS SO CLOSELY CONNECTED TO THE OFFENSE THAT A REASONABLE PERSON WOULD CONCLUDE THAT HE HAD A PERSONAL INTEREST IN THE MATTER WHERE THE CONVENING AUTHORITY WAS A DIRECTOR (AND THUS A FIDUCIARY) AND A DISTRICT CHAIRMAN IN THE VICTIMIZED ORGANIZATION, WHERE HE WAS PERSONALLY APPROACHED IN HIS CAPACITY AS DIRECTOR BY ANOTHER LEADER IN THE ORGANIZATION FOR ASSISTANCE IN HAVING APPELLANT INVESTIGATED FOR CONSENSUAL SEXUAL ACTIVITY, WHERE HE THEN INITIATED THE INVESTIGATION AND WHERE THE CONVENING AUTHORITY SUBSEQUENTLY OBTAINED COMMAND AND SPECIAL COURT-MARTIAL AUTHORITY OVER APPELLANT.

II. WHETHER THE FINDINGS AND SENTENCE OF APPELLANT'S COURT-MARTIAL MUST BE SET ASIDE WHERE APPELLANT'S PLEA OF GUILTY WAS PROCURED BY FALSE AND FRAUDULENT STATEMENTS MADE BY AIR FORCE OFFICIALS TO THE DEPARTMENT OF JUSTICE IN ORDER TO OBTAIN A GRANT OF IMMUNITY FOR A VITAL GOVERNMENT WITNESS, WHERE THE GOVERNMENT FAILED TO PRODUCE THE DOCUMENTS CONTAINING THESE FALSE STATEMENTS TO APPELLANT DURING DISCOVERY AT THE TRIAL AND APPELLATE LEVEL AND WHERE THE STAFF JUDGE ADVOCATE WAS AWARE OF THE FALSE STATEMENTS DURING THE POST-TRIAL PROCESSING OF APPELLANT'S COURT-MARTIAL BUT FAILED TO ADDRESS THIS ERROR IN THE ADDENDUM TO THE STAFF JUDGE ADVOCATE'S RECOMMENDATION.
