Overview of NAICS

The Federal Trade Commission (Commission) requires that persons filing a Hart-Scott-Rodino (HSR) notification with respect to a proposed transaction use the North American Industry Classification System (NAICS) to report their business activities in Items 5, 7 and 8 of the Notification and Report Form for Certain Mergers and Acquisitions (Form). As of January 29, 2006, filing persons are required to use 2002 rather than 1997 as the base year for reporting these activities and revenues generated by these activities. 70 Fed. Reg. 77312 (December 30, 2005). The federal register notice also instructs persons filing notification to consult the North American Industry Classification System-United States, 2002 (2002 NAICS Manual, PB2002-101430) to report information by 6-digit NAICS industry code and the 2002 Numerical List of Manufactured and Mineral Products (2002 Numerical List) to report 7-digit NAICS-based product class and 10-digit NAICS-based product code. The 2002 NAICS Manual is published by the Executive Office of the President, Office of Management and Budget; and the 2002 Numerical List is published by the U.S. Department of Commerce, Bureau of the Census.
