Re:  Your Freedom of Information Act appeal dated March 12, 2002

Dear Ms. Schwarz:

We received your March 12, 2002, Freedom of Information Act (FOIA) appeal on March 14.  Dianne Salva, NCUA’s FOIA Officer, responded to your FOIA request received on February 28, 2002, by administratively closing your request due to past due fees owed to another federal agency.  This is to advise you that your appeal also has been administratively closed for the same reason.  See  §792.26(b) of the NCUA Rules and Regulations, 12 C.F.R. §792.26(b).  You are required to substantiate that you have paid this debt before this Office takes action on any new appeals you submit.

Pursuant to 5 U.S.C. 552(a)(4)(B), you may seek judicial review of this determination by filing suit against the NCUA.  Such a suit may be filed in the United States District Court in the district where you reside, where your principal place of business is located, or in the District of Columbia.
