Some time back there was a discussion on this list regarding whether or not undocumented immigrants could/should/must be served by federally-funded programs. Could someone give me a definitive answer to the question: are we required or allowed to serve adult ESL/ABE students who don't have documents?

We are under a federal EL/Civics grant, and would like to be able to serve all comers, but are trying to slide around the legal status issue. Could we make it a policy to serve those who are not documented? Or would it be acceptable to "don't ask, don't tell"? Can we have an enrollment document that doesn't even address the issue and still be legal under the EL/Civics grant? What I think I understood from the earlier discussion was that adult ESL students fall under Plyler, and must be served, but I'm not sure enough to take the leap.
