Re:  Your FOIA appeal dated October 12, 2001

Dear Ms. Rainey:

On July 9, 2001, pursuant to the Freedom of Information Act (FOIA), you requested the yearly audit reports for Sentry Federal Credit Union and the Police and Fire Federal Credit Union for the years 1993 – 1997.  Tawana James, NCUA’s Region II Director, denied the request on September 14, 2001.  We received your October 12, 2001, appeal on October 18.  Your appeal is granted.  A copy of the audit report for Police and Fire Federal Credit Union, dated April 16, 1999, is enclosed.  This one audit report covers the years 1997 and 1998.  It was the only audit report for either of the two credit unions we found within NCUA records.  NCUA does not require a federal credit union to submit audit reports.  Rather, a federal credit union’s supervisory committee is required to provide a copy of an audit report if requested by NCUA.  See §715.10(a) of NCUA Rules and Regulations, 12 C.F.R. 715.10(a).  As Ms. James noted in her September 14 letter to you, §714.10(a) also provides a member of a federal credit union with access to an audit report.  If you are a member of either Sentry Federal Credit Union or the Police and Fire Federal Credit Union, you may contact them for access to any available audit reports.
