This is a very simple matter. The right to investigate and ultimately confront witnesses in court is far more fundemental and essential than the right of "privacy." In the end, the courts have eroded the Ninth Amendment "Right to Privacy" while endorsing and strengtheming the right of authorized individuals to engage in legitimate litigation support.
