1. The United States has the most innovative software industry on the planet. If you tell people that they must provide a warranty for software that they give away you will stifle that innovation by taking away part of the motivation for it. You will make it unsafe to share your creation with your peers. This sharing is a largely responsible for high quality coding. If you share within a community you receive comments and criticisms that allow you to enhance and perfect your own coding style. You then take those improvements to work with you.

2. I personally think that requiring someone to provide a warranty on something is to tight and direct a market control. I think that sort of thing should be demand driven. I do think that when they are not providing a warranty that it must be clearly stated. A well informed customer base can drive a fair and productive market.
