May 21, 1998: Prohibition of "Gag Clauses" in the Federal Employees Health Benefits Program; Notice of Proposed Rule Making

The Office of Personnel Management is proposing to amend the regulations to prohibit health benefit carriers participating in the Federal Employees Health Benefits (FEHB) Program from entering into contractual provisions with health care providers or health care workers that would include a provision for incentive payments as an inducement to reduce or limit communication with, or the delivery of health care services to, FEHB enrollees. The rule is intended to ensure providers' and health care workers' ability to communicate with, and advise patients of, any medically necessary treatment options. May 18, 1998: Submission for OMB Review: Comment Request for Reclearance of Expiring Information Collections

The Office of Personnel Management published two notices regarding submission to the Office of Management and Budget of requests for clearance of information collections under the Paperwork Reduction Act of 1995, as follows:

  • A new Generic Clearance Plan to measure customer satisfaction with the Retirement and Insurance Services' programs and services.  [Federal Register Notice: PDF or text]
  • SF 3104, Application for Death Benefits/Federal Employees Retirement System, which is used to apply for benefits under the Federal Employees Retirement System based on the death of an employee, former employee, or retiree who was covered by FERS at the time of his/her death or separation from Federal Service, and SF 3104B, Documentation and Elections in Support of Application for Death Benefits when Deceased was an Employee at the Time of Death, which is used by applicants for death benefits under FERS if the deceased was a Federal Employee at the time of death.   [Federal Register Notice: PDF or text]

May 13, 1998: Reduction in Force and Mandatory Exceptions; Final Rulemaking

The Office of Personnel Management (OPM) is issuing final regulations that implement legislation giving employees the right to use annual leave to establish initial retirement eligibility for employees in reduction in force and other restructuring situations. These regulations also implement related provisions concerning the availability of annual leave to qualify for continuance of health benefits in the same situation. May 12, 1998: Proposed Collection; Comment Request: Investigations Forms 41 through 44

Announces that OPM intends to submit to the Office of Management and Budget (OMB) a request for reclearance of four information collections and solicits comments on them. May 5, 1998: Submission for OMB Review; Comment Request for Reclearance of an Information Collection: Form RI 20-80

Announces that the Office of Personnel Management intends to submit to the Office of Management and Budget a request for reclearance of an information collection. RI 20-80, Alternative Annuity Election, is used for individuals who are eligible to elect whether to receive a reduced annuity and a lump-sum payment equal to their retirement contributions (alternative form of annuity) or an unreduced annuity and no lump sum. To obtain copies of this proposal please contact James M.
