Chapter 6: Intergovernmental and Other Committees Used by the Department

308 DM 6

6.1 Intergovernmental and Other Committees. There are other types of committees used by the Department which may not consist of Federal employees like intrabureau, Departmental, or interagency committees. Such non-federally created committees, though advisory in nature, may not be composed of members representing the general public. These committees may (1) be composed of representatives of State and local governments (Intergovernmental); or (2) be composed wholly of representatives of various non-profit organization (Non-profit); or (3) be local civic committees whose primary function is to render public service with respect to a Federal program (Public Service).

6.2 Exclusion from Requirements. Any local civic group whose primary function is that of rendering a public service with respect to a Federal program, or any State or local committee, council, board, commission, or similar group established to advise or make recommendations to State or local officials or agencies are exempted from the requirements of the Federal Advisory Committee Act (Public Law 92-463).

6.3 Subject to Provisions of 308 DM 2. The use of the types of committees described in 308 DM 6.1, which are not exempted by 308 DM 6.2, is subject to the same approval authority as prescribed for advisory committees (308 DM 2). To the extent that the Department proposes to use such committees, appropriate approvals as described in 308 DM 2.7 must be obtained by the using bureau/office.

6.4 Applicability. The provisions of 308 DM 6.3 apply only to such committees as are used by the Department. The provisions for participation in State, local and community committees not used by the Department are described in 308 DM 7.
