Occupancy and Use Restrictions

Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited on any area or forest development road or trail under my jurisdiction:.

  1. Occupying any campsite, or any combination of different campsites, for a period of longer than 14 calendar days within a thirty (30) day period in a designated recreation site; except for Lake Red Bluff Recreation Area which is covered under Items 3, 4, and 5 below. 36 CFR 261.58(a).
  2. Occupying any campsite, or any combination of different campsites, for a period of longer than 21 calendar days within a thirty (30) day period in the General Undeveloped Area of the Forest. 36 CFR 261.58(a).
  3. Occupying any developed campsite, or any combination of different developed campsites, in the Lake Red Bluff Recreation Area for a period longer than 10 calendar days within a 45 day period. 36 CFR 261.58(a).
  4. Camping in the general dispersed areas in the Lake Red Bluff Recreation Area. 36 CFR 261.58(e).
  5. Maximum number of occupants per campsite at Lake Red Bluff Recreation Area is eight (8). 36 CFR 261.58(f).
  6. Being publicly nude where a person may be observed by another person from the following:
    1. Developed Recreation Sites.
    2. Forest Developed Roads.
    3. Forest Developed Trails.
    4. Public buildings or structures.
    5. Private or public residences.
    36 CFR 261.58(j).

This order supersedes Order No. 08-91-01, dated March 9, 1991 and is in addition to Regional Order No. 77-4, dated March 8, 1977,

Pursuant to 36 CFR 261.50(e), each of the following persons are exempt from this order:

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
  2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

This prohibition is in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

A violation of this prohibition is punishable by a fine of not more that $5,000.00 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.
