Reserved Sections of the
NAGPRA Regulations
Responsibility for promulgating NAGPRA regulations, 43 CFR 10, rests with the Secretary of the Interior, who has delegated drafting responsibility to the National Park Service. Within NPS, the National NAGPRA program carries out this responsibility.
Three sections of the NAGPRA regulations remain to be promulgated --
43 CFR 10.7
Disposition of unclaimed human remains, funerary objects, sacred objects, or objects of cultural patrimony
This section of the regulations applies to cultural items found on Federal or tribal land after November 16, 1990. The National NAGPRA program is consulting with the Review Committee, Native American groups, and representatives of museums and the scientific community in developing this regulation, as required by the statute.

Summary of November 15-17, 2005 Consultation on 43 CFR 10.7.
Notice of April 18-20, 2007 Consultation on 43 CFR 10.7.
43 CFR 10.11
Disposition of culturally unidentifiable human remains
This section of the regulations will establish a process for the disposition of culturally unidentifiable human remains that are in museum and Federal agency collections. Key issues to be addressed include determining who may make a claim for culturally unidentifiable human remains, under what circumstances transfer may take place, and reporting requirements. A proposed rule implementing this section was published in the Federal Register on October 16, 2007. Comments accepted through January 14, 2008. View comments
