Description: US EPA Region 5 hereby gives notice of its intent to file a Consent Agreement and Final Order (CAFO) against the City of Wilimar (Willmar) for civil violations of the Clean Water Act (CWA).
This CAFO will settle EPA's allegations that in 2004, the Respondent violated the Minnesota National Pollutant Discharge Elimination System (NPDES) General Permit Number MNR 1100001 for Storm Water Discharges Associated with Construction Activity at the Wilimar Airport Project in Willmar, Minnesota. Prohibiting the discharge of any pollutant into navigable waters of the United States by any person, except in compliance with an NPDES Permit, is an integral goal of the CWA to restore and maintain the integrity of the nation’s water.
EPA and respondent have agreed that Respondent will pay penalty of $11,000 to resolve these violations.
