Chapter 2

Responsibilities

1. Scope. This chapter establishes the responsibilities of U.S. Geological Survey (USGS or Bureau) personnel to maintain compliance with both statutory and regulatory requirements and the management of USGS environmental programs.

2. Authorities/References. See Chapter 1, Section 2 of this Handbook.

3. Requirements. The USGS will comply with all Federal, State, and local statutory and regulatory requirements and Department of the Interior (DOI or Department) and USGS environmental management and compliance policy requirements.

4. Responsibilities.

A. Bureau Director.

(1) Provides management direction and support necessary for the USGS to effectively fulfill its policy commitments by holding associate and regional directors accountable for effectively fulfilling USGS environmental program responsibilities.

(2) Appoints a Designated Agency Safety and Health Official (DASHO) with sufficient authority to effectively represent the interest and support of the Director in the management and administration of USGS environmental programs.

(3) Provides adequate resources (staff and budget) to effectively implement and administer USGS environmental programs.

(4) Holds organizational managers accountable for effectively fulfilling their USGS environmental program responsibilities in their areas of responsibility.

(5) Requires compliance with statutory, regulatory, and program criteria.

(6) Provides management direction and support necessary for the Bureau to effectively fulfill its policy commitments. Holds the Bureau DASHO and regional directors accountable for effectively fulfilling USGS environmental program responsibilities.

(7) Ensures supplementing USGS environmental programs with special initiatives, directives, standards, criteria and training to meet unique environmental needs.

(8) Demonstrates personal commitment for the safety and health of employees, contractors, concessionaires, volunteers, and the public.

(9) Delegates authority on USGS environmental program matters to the Bureau DASHO.

(10) Ensures appointment of environmental professionals (meeting Office of Personnel Management (OPM) standard GS-028) as Environmental Protection Specialists as necessary and provides adequate resources for the effective implementation and administration of USGS environmental programs.

(11) Requires environmental evaluations of USGS headquarters and each region, State, or area, at least every 4 years where deficiencies are noted and recommends corrective actions be recorded and tracked until resolved.

(12) Requires that spills, accidents, and incidents be reported and investigated.

(13) Requires all facilities to be inspected at least annually and environmental compliance deficiencies abated on an identified schedule.

(14) Provides for personnel recognition for outstanding environmental management, compliance, and awareness performance.

(15) Submits reports to the Department on USGS environmental programs, as required or upon request that may include Bureau funding levels for USGS environmental programs, compliance audit and abatement activities, etc.

(16) Requires that managers and supervisors have State and local environmental rules and regulations, Title 40 of the Code of Federal Regulations (40 CFR), Executive Orders (EO), and departmental environmental policy readily available.

B. Designated Agency Safety and Health Official (DASHO). The Chief, Office of Administrative Policy and Services, serves as the DASHO for the USGS and is responsible for ensuring the establishment of and direction for the USGS environmental management and compliance program.

(1) Presents to the Director an annual report on the program.

(2) Includes environmental issues as agenda for the Executive Leadership Team (ELT) meetings briefings when appropriate.

(3) Exercises the authority of the Director for the management and administration of the program.

(4) Directs program activities through the Chief of Headquarters Office of Management Services and the Bureau Safety Manager and ensures that adequate resources are provided to the Safety and Environmental Management Branch (SEMB) to develop and administer the program.

(5) Promulgates policy, directives, and alternate or supplemental standards applicable for implementation of an effective program.

(6) Appoints Serious Accident Investigation Teams or Trained Investigators for the immediate and primary investigation of serious environmental spills and accidents, when deemed appropriate.

(7) Encourages the use of the USGS Environmental Management Council (See 308.63 Environmental Management Council) as the forum for the exchange of program information as a focal point for coordinating environmental activities and as a vehicle for formulating recommendations to the DASHO/ELT regarding the program.

(8) Provides pertinent information concerning the Bureau's program to the Department of the Interior upon request, including interim and annual progress reports of the Bureau's environmental program implementation.

(9) Advises the Director and the ELT of the status of the program via the submittal periodic status reports as necessary.

(10) Designates a qualified environmental professional (meeting OPM qualifications for GS-028/0819) to review applicants and/or provide guidance to bureau organizations in the selection of environmental management and protection employees. The reviewer must be at an equal or higher grade level to that of the vacancy.

C. Chief, Headquarter Office of Management Services (OMS). Serves as a member on the bureau Environmental Management Council (See 308.63 Environmental Management Council) and directs USGS Environmental Management and Compliance Program activities through the Bureau Occupational Health, Safety and Environmental Program Manager.

D. Bureau Occupational Health, Safety and Environmental Program Manager. Responsible for environmental program oversight and development as described in this manual and serves as a member on the Bureau Environmental Management council (See 308.63 Environmental Management Council).

(1) Recommends Bureau organizations establish environmental management and compliance review boards, councils, or committees to provide for employee involvement and to enhance the program where deemed necessary. These may be combined with any safety and health committees or councils already established.

(2) Ensures and coordinates the development of USGS program policies, directives, alternate or supplemental standards, and guidelines.

(3) Advises and supports the Bureau DASHO in carrying out program responsibilities.

(4) Advises Bureau-wide organizational management environmental program administration, and provides Bureau-wide program guidance and coordination for all basic program elements.

(5) Participates in Department of the Interior environmental councils, committees, and working groups, as requested.

(6) Ensures the conduct of program evaluations of Bureau headquarters and each region at least every 4 years.

(7) Evaluates Bureau and regional safety and environmental staffing for their managerial effort and effectiveness in establishing and implementing the bureau program.

(8) Exercises appropriate action on requests for variances from applicable environmental standards, and submits requests for alternatives to Federal, State, or local regulations or changes to departmental environmental standards to the Office of Environmental Compliance for appropriate action.

(9) Ensures that allegations of reprisal related to the program, reports of unsafe and unhealthful conditions, and accidents/incidents are investigated. Reviews reprisal investigation reports not resolved at the regional level, and provides recommendations for resolution to the DASHO.

(10) Directs the development of policies and the establishment and monitoring Bureau-wide environmental contracts.

(11) Oversees the identification and development of Bureau-wide environmental training and professional development programs.

(12) Programs and coordinates with the USGS Office of Human Resources regarding professional and career development of environmental personnel.

(13) Coordinates use of the automated Safety Management Information System (SMIS) to support USGS needs for collecting, assimilating, and analyzing environmental incidents (employee, contractor, or public) related to the Bureau's operations and/or facilities.

(14) Serves as the Bureau's principal representative to the EPA and other agencies on technical matters pertaining to the USGS safety and environmental programs.

(15) Provides Regional Safety Managers (RSM's) and Regional Environmental Protection Specialists (REPS) with the interpretation of EPA and other applicable agency adopted national consensus standards, and Departmental and USGS safety and health standards.

(16) Provides oversight for appropriate initiatives, directives, standards, criteria to meet contractor concessionaire, volunteer, and public environmental requirements.

E. Bureau Environmental Protection Specialist (BEPS). Provides, as the USGS technical environmental advisor, assistance and guidance to the Bureau Occupational Health, Safety and Environmental Program Manager and regional management in carrying out activities, such as:

(1) Assists Regions in the implementation of Bureau policy, plans, programs, directives and rules.

(2) Responds to direct requests for services from the RSM's and REPS.

(3) Identifies and develops environmental training requirements and environmental promotion/awareness programs.

(4) Interprets environmental policy and procedures.

(5) Provides the regional unit management with information on program compliance and effectiveness by conducting surveys, inspections, and staff visits.

(6) Investigates, reports, and analyzes environmental incidents.

(7) Identifies and recommends appropriate actions to correct program deficiencies and track them until they are resolved.

(8) Develops template spill prevention and environmental program plans that address environmental program media.

(9) Provides guidance and assistance in environmental safety, including hazardous waste management, facility compliance regarding wastewater and air emissions, pesticides, underground storage tanks and other environmental media.

(10) Serves as the qualified environmental specialist meeting the OPM qualifications for GS-028 to serve as subject matter expert for review of applicants for full-time Bureau environmental position vacancies.

(11) Reviews environmental incident information recorded in SMIS to determine its accuracy and completeness and takes appropriate action to correct deficiencies.

(12) Assists the BSM in the development and implementation of appropriate initiatives, directives, standards, criteria to meet contractor concessionaire, and volunteer environmental requirements.

(13) Provides program implementation and compliance assistance to RSM's and REPS with regard to all environmental media, including, but not limited to, hazardous waste management, wastewater, drinking water, air quality, pesticides, and underground storage tanks.

(14) Assists the BSM and RSM's/Officers and REPS in the interpretation of Federal, State, and local regulations, Executive Orders, and Departmental and USGS environmental policy and directives.

(15) Assists the RSM's and REPS in establishing environmental services contracts as necessary.

(16) Participates in Department of the Interior environmental councils, committees, and working groups, as requested.

(17) Provide RSM's and REPS with environmental program statistical reports and prevention recommendations.

(18) Chairs the Bureau Environmental management council (See 308.63 Environmental Management Council).

F. Associate Directors (AD).

(1) Coordinate and provide oversight for the Program and assistance to organizational managers, supervisors, and personnel in program implementation for science program areas within their scope of responsibility.

(2) Require compliance with statutory, regulatory, and program criteria and provide management direction and support necessary to effectively fulfill its policy commitments.

(3) Supplement the environmental management program with special initiatives, directives, standards, criteria, and training to meet the unique environmental compliance needs within their areas of responsibility.

(4) Demonstrate personal commitment for the environmental management program by establishing management and supervision accountability for effectively fulfilling environmental responsibilities within their organizational program areas.

(5) Implement and administer the environmental management program within their area of responsibility by delegating sufficient authority to management and collateral duty personnel.

(6) Provide adequate staff/budget resources to effectively administer the environmental management and compliance program within their area of responsibility.

(7) Require self-conducted environmental program evaluations and facility inspections of operational locations annually.

(8) Require formal environmental management and compliance evaluations and facility inspections of operational locations based on compliance risk and program deficiencies.

(9)Require that all inspection deficiencies noted and corrective actions recommended are documented and tracked until resolved.

(10) Provide recognition to employees for outstanding environmental performance.

G. Regional Directors.

(1) Requires compliance with statutory, regulatory, and program criteria. Provide management direction and support necessary for the region to effectively fulfill its policy commitments.

(2) Supplements the program with special initiatives, directives, standards, criteria, and training to meet the unique safety and health needs of the regions.

(3) Establishes Regional Executive and field management/supervision accountability for effectively fulfilling environmental management responsibilities within their organizational and program areas.

(4) Delegates authority on environmental management and compliance matters to the RSM through the respective Chief, Regional Administrative Services Center, with sufficient authority to effectively represent the interest and support of the region in the management and administration of the program.

(5) Provides adequate staff/budget resources to effectively administer and implement the regional program.

(6) Ensures environmental protection specialists (meeting OPM standard GS-0028) as regional environmental program managers and provide adequate resources for the effective implementation and administration of the program within the region.

(7) Requires formal environmental compliance audits of regional headquarters and field locations at least every four years. Deficiencies noted and recommended corrective actions will be recorded in writing and tracked until resolved.

(8) Requires all facilities to conduct internal environmental compliance audits annually and deficiencies abated as established on an action plan.

(9) Provides recognition to employees for outstanding Regional environmental protection performance.

(10) Submits to the Bureau DASHO through the BSM, an annual report on the Regional Environmental Program Action Plan.

(11) Ensures that Regional Operations and Scientific Projects undergo regular review to ensure environmental compliance. Deficiencies noted and recommended corrective actions will be recorded in writing and tracked until resolved.

H. Regional Executives (REX).

(1) Ensure support is provided to coordinate/oversee the regional science program and to assist field Collateral Duty Environmental Program coordinators, organizational managers, supervisors and employees in program implementation. The Regional Safety Officers (RSO's), Collateral Duty Safety Program Coordinators, Collateral Duty Environmental Program Coordinators, and Chemical Hygiene Officers are responsible for providing support services to respective field or science organizational managers, supervisors, and employees to assist in program element implementation within their organizational boundaries.

(2) Require compliance with statutory, regulatory, and program criteria. Provide field-level manager and supervisor direction and support necessary for the region's science organizations to effectively fulfill bureau policy commitments.

(3) Supplement the region's science program with special initiatives, directives, standards, criteria and training to meet the unique environmental needs of the regions.

(4) Demonstrate personal commitment for the safety and health of employees, contractors, concessionaires, volunteers and the public.

(5) Establish field manager and supervisor accountability for effectively fulfilling environmental responsibilities within their organizational and program areas.

(6) Delegate management and administrative authority on safety, occupational health and environmental program matters to the RSO, with sufficient authority to effectively represent the interest of and support to the respective regional science organization.

(7) Provide adequate staff/budget resources to effectively administer the regional science safety program.

(8) Require self-conducted environmental management and compliance program evaluations and facility inspections of science program field locations annually. Require formal environmental management and compliance program evaluations and facility inspections of science program field locations based on compliance risk and program deficiencies. All regional discipline organizations falling under the EMS or baseline audit location umbrella shall be audited every 4 year. All deficiencies noted and recommended corrective actions will be recorded in writing and tracked until resolved.

(9) Provide recognition for outstanding safety and environmental performance within their respective area of responsibility.

(10) Ensure annual reporting on the regional science safety, health and environmental program and abstracts of investigation reports on serious accidents, and other reports are provided to the RSM, as requested.

I. Chief, Regional Administrative Service Centers. Directs Regional Environmental Management and Compliance Program activities through RSM.

J. Regional Safety Managers (RSM's) and Regional Environmental Protection Specialists (REPS).

(1) Administer the region-wide safety, health, and environmental program, reporting to Chief, Office of Regional Services through the Chief, Regional Office of Management Services.

(2) Advise and support the regional ELT on safety and environmental issues and concerns and program responsibilities.

(3) Plan, direct, schedule and coordinate regional safety and environmental committee activities. The Regional Safety Manager shall serve as Chairperson. The RSM shall also serve as the regional representative on the USGS Environmental Council (See 308.63 Environmental Management Council).

(4) Conduct and document environmental management and compliance program evaluations of regional discipline level programs every 4 years. All deficiencies noted and recommended corrective actions will be recorded in writing and tracked until resolved.

(5) Conduct and document environmental management and compliance program evaluations/inspections of discipline field organizations based on compliance risk and past program deficiencies.. All deficiencies noted and recommended corrective actions will be recorded in writing and tracked until resolved.

(6) Coordinate/track regional offices corrective actions through final abatement action and review regional field location corrective actions annually.

(7) Evaluate regional safety and environmental staffing.

(8) Submit requests for alternatives to Federal, State, or local regulations or changes to USGS environmental standards to the BSM for appropriate action. Exercise appropriate action on field unit requests for variances from applicable environmental standards.

(9) Ensure allegations of reprisal, reports of adverse environmental conditions, and accidents/incidents related to the regional headquarter program are investigated. Review reports of allegation-of-reprisal investigations not resolved at the field location level, providing recommendations to the RSM and REPS for resolution. Forward reports not resolved at the regional level to the BSM for resolution.

(10) As the region's technical safety, environment, and health advisor, provide assistance and guidance to regional ELT, RSO's, and REPS with respect to implementation and compliance with the program elements in chapter 1, section 3C.

(11) Serve as or designate qualified environmental specialist (meeting the OPM qualifications for GS-029/0819) to serve as subject matter expert for review of applicants for full-time regional environmental vacancies. The reviewer must hold an equal or higher grade level to that of the vacancy.

(12) Ensure review of region-wide environmental incident information that is recorded in SMIS to determine its accuracy and completeness and ensure that appropriate action is taken to correct deficiencies. Coordinate use of the automated SMIS to support USGS and regional needs for collecting, assimilating, and analyzing accidents (employee, contractor, or public) involving injuries, illnesses, and property damage related to the region's operations and/or facilities.

(13) Serve as the principle accident investigator and team coordinator for the conduct of serious environmental incidents outside their region, as designated by the BSM.

(14) Recommend program policies, directives, alternate or supplemental standards, and guidelines for adoption at the Bureau level, and interpret regulation and guidance for the region, working with the BSM.

(15) Serve as the region's principal representative to Federal, State, and local agencies on technical matters pertaining to regional environmental programs. Serve as the Bureau's regional contact on sensitive issues for regulatory authority.

(16) Provide and coordinate region-wide program direction and provides technical assistance to Regional Safety Officers, and as needed, to all managers, supervisors, and employees throughout the region with regard to EPA, Departmental, and USGS environmental standards.

(17) Coordinate with RSO's to ensure support and assistance is provided in effectively meeting bureau, regional, and field/science safety program needs.

(18) Coordinate Bureau and regional data calls and compile regional reports for submittal to the Bureau.

(19) Coordinate the identification, development, and consolidation of regional training plans and conduct of environmental training.

(20) Coordinate the development and maintenance of regional environmental promotional programs.

K. Regional Safety Officers (RSO's).

(1) Administer the regional environmental program for their respective science areas and field locations, reporting to their respective regional executive.

(2) Advise and support regional science and field management in implementation and compliance with program responsibilities.

(3) Participate as a member on the regional Safety and Environmental Committee and working groups arising from subject activities, as necessary.

(4) Coordinate self-conducted environmental program evaluations of regional science field organizations annually.

(5) Coordinate and track regional science field location corrective actions through final abatement action.

(6) Evaluate regional science location safety and environmental staffing for managerial effort and effectiveness in establishing and implementing the safety and environmental programs.

(7) Submit requests for alternatives to EPA regulations, changes to USGS environmental standards, and variances from applicable environmental standards to the RSM for appropriate action.

(8) Provide, as the science technical safety, environmental, and health advisors, assistance to field-level management and Collateral Duty Safety and Environmental Program Coordinators in implementation and compliance with the program elements in chapter 1, section 3C.

(9) Ensure review of respective regional field organization environmental incident information recorded in SMIS to determine its accuracy and completeness, and ensure that appropriate action is taken to correct deficiencies. Coordinate use of the automated SMIS to support field and science needs for collecting, assimilating, and analyzing accidents (employee, contractor, or public) involving injuries, illnesses, and property damage related to hazardous material spills and releases. Ensure corrective action(s) are taken to prevent recurrence.

(10) Provide annual field organizational environmental management and compliance status reports to regional science and field management, as necessary.

(11) Recommend program policies, directives, alternate or supplemental standards, and guidelines to the RSM for adoption at the Bureau level.

(12) Coordinate field unit environmental program implementation.

(13) Assist the Collateral Duty Environmental Program Coordinators in the identification, development, and conduct of general and specialized environmental training to meet field level science needs.

(16) Coordinate the development and maintenance of safety promotional programs, and participate in region-wide awareness and promotional programs in coordination with the RSM.

(17) Coordinate, provide assistance, and share expertise with the RSM and other RSO's to meet overall regional safety and environmental program needs.

L. Field, District, Center, and Team Line Managers and Supervisors.

(1) Implement program requirements within the scope of authority.

(2) Provide and/or secure appropriate environmental training for employees.

(3) Monitor operations and activities and inspect work areas for environmentally hazardous conditions. Abate deficiencies as soon as possible.

(4) Hold employees accountable for their environmental protection performance and maintain their performance standards.

(5) Require environmental protection requirements be integrated into every job standard.

(6) Ensure routine inspections of facilities.

(7) Appoint appropriate personnel resources (i.e., Collateral Duty Environmental Program Coordinators and Chemical Hygiene Officers) to provide support services to respective organizational management, supervisors, and employees to assist in program element implementation within their respective organizational boundaries.

(8) Supervisory/management responsibility includes ensuring the general program elements described in this Handbook are carried out within the sphere of their authority. USGS managers responsible for contract operations shall ensure those activities are carried out in compliance with this Handbook.

(9) Establish and document an environmental awareness program.

(10) Demonstrate personal commitment and actively participate in the environmental management and compliance program.

(11) Investigate and report job-related accidents that result in or have the potential to cause injury, illness, or property damage caused from the spill or release of hazardous materials. Ensure that all such incidents are reported using the data entry screens provided by SMIS at the Web address http://www.smis.doi.gov.

(12) Ensure that all serious environmental incidents are reported by telephone within 4 hours of occurrence to the RSO, RSM, and BSM. Serious incidents shall be investigated by an investigative team, appointed by the BSM, and shall consist of Departmental and/or USGS personnel outside the immediate organization's region and science area.

(13) Require environmental management and compliance to be integrated into the planning of every job.

(14) USGS managers responsible for contract operations shall ensure those activities are carried out in compliance with this Handbook.

(15) Coordinate the review of field organization Notices of Violation (NOV) or other enforcement action issued by the State environmental regulatory agency or the EPA to determine accuracy and completeness and appropriate action taken to correct deficiencies.

M. Collateral Duty Environmental Program Coordinators (CDEPC).

(1) The CDEPC provides managers and supervisors with assistance in administering the environmental program.

(2) Support field organizational managers and supervisors in implementation and compliance with program responsibilities.

(3) Develop and maintain Environmental Management Plan that addresses standard operating procedures at the organizational level for implementation and compliance with each element of the organizational environmental management and compliance program as cited in paragraph (11) below.

(4) Participate, upon request, as a member on the Region-wide Safety and Environmental Committee and working groups arising from subject activities to provide field expertise in region-wide programs, problems or issues.

(5) Coordinate and document self-conducted program and facility inspections annually unless conducted by higher headquarter staff during the same fiscal year.

(6) Coordinate/track organization corrective actions through final abatement action.

(7) Submit requests for alternatives to Federal, State, and local regulations and changes to DOI/USGS environmental management and compliance standards and variances from applicable environmental management and compliance standards to the RSO or RSM for appropriate action. Recommend policy reform to the RSO or RSM.

(8) Ensure allegations of reprisal, reports of unsafe and unhealthful conditions, and environmental spills, accidents, or incidents related to the organization are investigated.

(9) Provide assistance to field-level managers and supervisors in implementation and compliance with the program elements listed chapter 1, section 3C.

(10) Coordinate field-level contract establishment as needed for areas such as hazardous waste disposal and other environmental services as needed.

(11) Assist managers and supervisors in the identification of environmental training.

(12) Coordinate the development and maintenance of field organization environmental promotional and awards/recognition programs aimed at providing information to specific target audiences, inclusive of making available/recommending environmental training materials, journals, reference documents, posters, signs, etc.

(13) Maintain a library or have access to environmental reference publications and regulations to include, at a minimum, this Handbook, Department policy, appropriate State environmental rules and regulations, and EPA rules and regulations.

(14) Publicize policies and procedures to ensure an effective environmental program.

(15) Provides environmental program coordination with the Federal and State regulators, as needed.

(16) Coordinate the acquisition of appropriate spill response supplies and equipment are available.

N. All USGS Employees.

(1) Comply with the environmental rules and regulations that apply to their duties.

(2) Maintain a general awareness of all applicable USGS environmental policies and goals.

(3) Incorporate environmentally safe practices and procedures into daily operations.

(4) Emphasize environmental awareness and incorporate environmental compliance into every aspect of operational practices.

(5) Promote pollution prevention as the primary means of achieving and maintaining compliance with environmental requirements.

(6) Report unsafe and/or unhealthful conditions that may negatively impact the environment.

(7) Actively participate in environmental education and training activities.

O. Employee Representatives. Participate in activities, such as:

(1) Formal annual inspection of establishments.

(2) The identification of noncompliance or environmentally unfriendly conditions.

(3) The review of proposed environmental work rules and regulations.

P. USGS Safety and Environmental Councils, Committees, and Working Groups. (See 308.63 Environmental Management Council )and 308.64 Occupational Safety and Health Council).

(1) Council and Committee activities provide a focal point for coordinating and exchange of program activities and information at specific bureau, regional and field organizational levels.

(2) Review and advise the head of their organizational unit of possible ways to improve the program.

(3) Provide a channel of communication between employees and management to assist management in providing a safe and healthful workplace.

(4) Encourage employees to comply with pertinent safety and health requirements.

(5) Encourage employees to practice safe procedures during off-duty activities.

Q. USGS Environmental Management Council. (See 308.63 Environmental Management Council).

(1) Serves as an advisory body on environmental and compliance program matters to the DASHO and ELT.

(2) Provides a focal point for coordinating USGS environmental program activities.

(3) Provides a forum for the exchange of program information between SEMB and regional safety and health managers.

R. USGS Regional Safety, Health, and Environmental Committees. Serve as the advisory body on regional environmental management and compliance program issues to the Regional Director and Regional ELT's (See. 308.65 Regional Occupational Safety, Health, and Environmental Committees).

S. Field Unit Organization Committees. Serve as an advisory body on program matters to local organizational management.

T. Environmental Working Groups. Bureau or regional committees may establish environmental Working Groups as necessary to address specific program, operational, or science program-specific issues and to assist in developing drafts of program guidelines and other documentation and in conducting research on safety and health issues.

5. Additional Resources.

A. Office of Environmental Policy and Compliance
