In 2002 he was Counsel for Homeland Security to Rep. Rob Portman (R-OH) on the House Select Committee on Homeland Security. Before that, he was Assistant General Counsel for Indianapolis Power & Light Co. in Washington, D.C. He maintained a private law practice in the District of Columbia from 1994-95. Prior to that, he served as Counsel on the House Committee on Standards of Official Conduct and worked on electric power issues for Baker & Daniels, a Washington-based trade association. From 1980-88, he worked as a staff member on the House Committee on Appropriations, Subcommittee on Energy and Water Development.

McCarthy has a law degree from George Mason University School of Law (1980) in Virginia, where he was a Carrolls Scholar, and a B.A. from the University of Notre Dame in Indiana, where he was a Hoosier Scholar. He is a member of the District of Columbia and Virginia State Bar Associations.
