AMENDED ORDER TO PAY
The Federal Deposit Insurance Corporation ("FDIC") issued a NOTICE OF ASSESSMENT OF CIVIL MONEY PENALTIES, FINDINGS OF FACT, CONCLUSIONS OF LAW, ORDER TO PAY, AND NOTICE OF HEARING ("NOTICE") on October 12, 1989, against George T. Sweeney, Charles R. Sillstrop, William G. Ross, Barbara J. Powers, Harold R. Lacy, Robert E. Grey, and Robert L. Davis, Jr., assessing civil money penalties in the amounts of $380,000, $55,000, $20,000, $20,000, $5,000, $46,000, and $5,000, respectively.
Following the issuance of the NOTICE, Respondents Harold R. Lacy and Robert L. Davis, Jr. ("Respondents"), through counsel, offered to settle all matters relating to them in the NOTICE by payment of the sums of $3,000 and $1,000, respectively. On April 24, 1990, the Board of Directors of the FDIC accepted these settlement offers.
Thereafter, Respondents and the FDIC executed a STIPULATION AND CONSENT TO THE ISSUANCE OF AN AMENDED ORDER TO PAY ("CONSENT AGREEMENT"), whereby the respondents solely for the purpose of this proceeding and without admitting or denying any violation of law or regulation alleged in the NOTICE, consented and agreed to pay civil money penalties in the amounts of $3,000 and $1,000, respectively, to the Treasurer of the United States.
After taking into account said CONSENT AGREEMENT, the appropriateness of the penalties with respect to the financial resources and good faith of the Respondents, the gravity of the violations by the Respondents, the history of previous violations by the Respondents, and such other matters as justice requires, the FDIC issues the following:
Amended Order to Pay
IT IS HEREBY ORDERED, that the ORDER TO PAY issued on October 12, 1989
{{10-31-92 p.C-506}}against George T. Sweeney, Charles R. Sillstrop, William G. Ross, Barbara J. Powers, Harold R. Lacy, Robert E. Grey, and Robert L. Davis, Jr. is hereby amended as to Respondents Harold R. Lacy and Robert L. Davis, Jr.; and
IT IS FURTHER ORDERED, that Respondent Harold R. Lacy is hereby assessed and shall pay a civil money penalty in the amount of $3,000 to the Treasurer of the United States; and
IT IS FURTHER ORDERED, that Respondent Robert L. Davis, Jr., is hereby assessed and shall pay a civil money penalty in the amount of $1,000 to the Treasurer of the United States; and
IT IS FURTHER ORDERED, that the above-mentioned amended civil money penalties shall be paid immediately upon issuance of this AMENDED ORDER TO PAY.
