Dear Mr. Hoak:

This is in response to your letter dated June 10, 1975 requesting an interpretation of a construction standard.

Section 1926.902(d) of the OSHA construction standards does not apply to over the highway transportation of explosives. The Department of Transportation has jurisdiction in that area and permits under 49 CFR 177.835(g) the simultaneous transportation of blasting caps with other explosives on the same vehicle under certain conditions.
