Addressing Civil Rights in the Response to H1N1 Influenza

As we respond to H1N1 influenza, it is important to remain vigilant in ensuring civil rights compliance. Access to accurate emergency and health information is critical to providing all people with the ability to make informed decisions and protect themselves, their families, and the community at large. In addition, science and the law must lead our efforts to ensure that unfounded fear and/or prejudice do not limit access to housing, education, benefits, services, employment, and information on account of race, color, national origin, disability, or other protected status.

HUD has charged the owner and property managers of the Homestead Mobile Home Village, located in Gulfport, MS, with violation of the Fair Housing Act based on race/color.

HUD has charged Pearl and Gregory Beck, two landlords in Detroit Lakes, MN with violation of the Fair Housing Act on the basis of race. The Becks refused to rent a single-family rental house to the complainant who is black.

HUD v. Robert W. Hill, Roger Thuot and the Fitchburg Housing Authority

HUD has charged Robert W. Hill, Roger Thuot and the Fitchburg Housing Authority, Massachusetts, with violation of the Fair Housing Act. The Complainant is a person with disability who has multiple sclerosis and a depression/anxiety disorder. After numerous complaints to the Fitchburg Housing Authority regarding the excessive noise from and the hostile behavior of her neighbor, the Complainant requested a transfer to another apartment. The transfer request was denied.

HUD has charged Warren Properties, Inc., Laurie Weaver and Evelyn Graves, Mobile, Alabama, with refusing to grant a reasonable accommodation to a person with disability. Complainant requested a transfer from a second floor unit to a first floor unit due to her mobility impairment.

HUD v. Equity Homes, etc.

HUD has filed three charges of discrimination against the developers and others involved in the design and construction of three multifamily housing complexes in Sioux Falls, South Dakota for failing to provide accessible features required by the Fair Housing Act.  According to the charges, the developer Equity Homes, Inc., along with various other entities including BBR, LLC, PBR, LLC, JSA Consulting and Engineering, and Shane Hartung, d/b/a Hartung Design, failed to design and construct accessible dwelling units and public and common use areas at Beverly Gardens Apartments, Sertoma Hills Apartments and Villas, and West Briar Estates, in violation of the Act.
