CHARGE       : "The article is subject to refusal of admission
               pursuant to Section 801(a)(3) in that it appears
               to consist in whole or in part, of a filthy,
               putrid, or decomposed substance, or is otherwise
               unfit for food in that it appears to contain mold
               [Adulteration, Section 402(a)(3)]."

RECOMMENDING

REASON FOR
ALERT        : Between August 19, 1991, and October 21, 1991,
               BUF-DO analyzed five entries of canned tomatoes
               from Italy.  Violative levels of mold were found
               in three of the five entries with mold counts
               ranging from 17% to 30%.  The shipments contained
               products packed under several brand names and BUF-
               DO has been unable to confirm the identity of the
               manufacturer(s).

               From October 24, 1993, through December 16, 1993,
               BUF-DO analyzed six entries for mold.  Five
               entries were found to contain excessive mold.  The
               mold count averages ranged from 15% to 49%.  The
               product was packed in institutional size cans
               ranging from 5lb. 12oz. to 6lb. 12oz.

               The method of analysis used was AOAC 15th ed.,
               Section 945-90.

INSTRUCTIONS : Automatically detain all shipments of the
               specified tomato products from the
               manufacturers/shippers listed in the attachment to
               this alert.
