State Voluntary Cleanup Program Guidance History

EPA developed a framework for negotiations between Regions and States using Superfund Memoranda of Agreement (SMOAs) concerning division of labor for voluntary cleanup programs (see November 1996 memorandum below). In September 1997, EPA drafted guidance that was more specific than the November 1996 framework (see September 1997 Federal Register documents listed below). After many discussions with various stakeholders, however, EPA concluded that there was no consensus on critical aspects of the guidance. EPA further concluded that the flexibility offered in the November 14, 1996 framework provided the appropriate level of guidance for future SMOA negotiations. Thus, on November 26, 1997, EPA withdrew the September 9, 1997 draft of the guidance (see memorandum of withdrawal listed below). The framework discussed in the November 14, 1996 memorandum remains pertinent to current Regional/State SMOA negotiations concerning State VCPs.
