BACKGROUND In order to obtain input and recommendations about the competitive bidding program, the statute requires Medicare to establish and administer a Program Advisory and Oversight Committee (PAOC) to provide advice on the development and implementation of the Competitive Acquisition Program. Section 302 of the Medicare Modernization Act of 2003 (MMA), states that the goals of the committee are to provide advice on the following: - The implementation of the Competitive Acquisition Program.
- The establishment of financial standards that take into account the needs of small providers.
- The establishment of requirements for collection of data for the efficient management of the program.
- The development of proposals for efficient interaction among manufacturers, providers of services, suppliers, and individuals.
- The establishment of quality standards.
In addition, the MMA states that the committee may also perform additional functions to assist the Secretary. The Medicare Improvements for Patients and Providers Act of 2008 (MIPPA) delayed implementation of the competitive bidding program and extended the PAOC for two years, changing the termination date from December 31, 2009 to December 31, 2011. The term of the first committee members ended in 2008. New PAOC members have been appointed to advise CMS as it proceeds with the restart of the competitive bidding program.
