FY 2009 IPPS Rule – CMS-1390-F was published in the Federal Register on 8/19/2008 (73 FR 48434). Some of the physician self-referral provisions finalized in this rule are: "Stand in the Shoes," the Disclosure of Financial Relationships Report (DFRR), Period of Disallowance, Alternative Method for Compliance with Certain Exceptions, Percentage-based Compensation Formulae, Unit-of-Service (Per-Click) Payments in Lease Arrangements, Services Provided "Under Arrangements," exception for OB Malpractice Insurance Subsidies, Ownership or Investment Interest in Retirement Plans, and Burden of Proof. In this final rule, CMS has updated the List of Codes of Designated Health Services (DHS). CMS also discusses the Physician Self-referral Exception for Incentive Payment and Shared Savings Programs, and Reassignment Rules Related to Diagnostic Tests (Anti-markup).
