An Overview of the Federal Circuit's Caseload Presented by Chief Judge Michel to the Edward Coke Appellate Inn of Court of March 5, 2009
Using detailed statistics charts, Chief Judge Paul Michel presented an
overview of the Federal Circuit's caseload to members of the Edward Coke Appellate Inn of Court at the Inn's March 5, 2009 meeting. These charts include
information on the types of appeals filed at the Federal Circuit, details on the results of decisions on district court infringement appeals, information on
petitions for rehearing en banc, pendency time of appeals, number of petitions for writs of certiorari in Federal Circuit cases and mediation statistics.
Several of the charts compare the Federal Circuit's workload with that of the other circuit courts of appeals.

Mediation Program Fourth Quarter and Calendar Year Statistical Reports Now Available
The United States Court of Appeals for the Federal Circuit's Mediation Program has issued statistical reports of its activites for the fourth quarter and calendar year 2008.
Federal Circuit Now Posting Orders Processed through Office of the Senior Staff Attorney
On February 2, 2009, the Court began posting electronic versions of orders processed through the Office of the Senior Staff
Attorney (SSA) on or after January 30, 2009. To search for orders, click
here. Most orders processed through SSA will now include an electronic signature of the Clerk of the Court rather than a handwritten
signature. If an order was approved or authored by a judge or panel of judges, the order will include the name of that judge or judges.
Federal Circuit to Provide Wireless Internet Access to Members of the Bar
Beginning Monday, February 2, 2009, members of the bar will be able to access the Internet via a wireless connection provided by the court.
Those interested in using the Court’s system to access the Internet must visit the Clerk’s Office, Suite 401 in person to obtain a password and log-in information.
Access is available in the 2nd floor lobby, the 4th floor lobby, and the Circuit Library. Users of the Court’s wireless Internet access system must read the
Disclaimer and the FAQs before accessing the system.

Chief Judge Michel's Speech to the Association of Corporate Patent Counsel on January 28, 2009
Due to snowstorms, Chief Judge Paul Michel was prevented from traveling to Puerto Rico to deliver a scheduled speech to the
Association of Corporate Patent Counsel on January 28, 200. The
speech as prepared for delivery was, however, distributed to attendees at the annual meeting of ACPC. In anticipation of a new
patent reform bill in the Senate and in response to the on-going FTC hearings, the speech concerns what adjustments in patent litigation may still need legislative intervention
even after landmark decisions since the 2003 FTC report by the U.S. Supreme Court and the Court of Appeals for the Federal Circuit, and in view of new empirical information
available.

Federal Circuit Updates its Internal Operating Procedures
The Federal Circuit updated its Internal Operating Procedures on November 14, 2008. Earlier this year, the Federal Circuit provided to the public its proposed changes to
the IOPs. After receiving several comments from the public, the court voted to approve changes to its IOPs. In addition to general changes to update the IOPs, the Federal
Circuit also added two new sections in response to suggestions from the public. First, the Federal Circuit added a new paragraph at the beginning of IOP # 3 to briefly explain
how cases are assigned to merits panels. Second, the Federal Circuit added to IOP # 10 a new paragraph # 5 that briefly explains how precedential opinions are circulated before
issuance.

moderates a panel discussion titled "Perspectives of Technology and Innovation: The Trial Courts' View", Chief Judge
Michel and Judges Rader, Linn, and Prost participate in a panel discussion titled "Perspectives on Technology and
Innovation: Thoughts from the Circuit Level", and Judges Newman and Mayer participate in a round table discussion

Federal Circuit Announces
Proposed Amendments to Its Internal Operating Procedures and a Public Comment Period on June 20, 2008
The United States Court of Appeals for the Federal Circuit issued a notice on June 20, 2008 announcing proposed
amendments to its Internal Operating Procedures (IOP). The proposed IOPs are available here. Note that revised material
is shown in green, stricken material is shown by strikethrough, and new material is underlined. These amendments are
subject to public notice and comment under 28 U.S.C. § 2071(b). Those planning to submit comments on the proposed
changes must follow the format set out in the "Format for Proposing Changes to Federal Circuit Rules & IOPs” available
here. Public comments are due by July 18, 2008.

23rd Annual Intellectual Property Law Conference on April 10-12, 2008
Judges and mediation staff of the court will participate in the ABA's Section of
Intellectual Property 23rd Annual Conference set to take place from April 10 to 12, 2008 in Arlington, Virginia.
On Thursday, April 10, 2008, Chief Judge Paul Michel will participate in a panel discussion titled "What Patent Reform Really Means for You" and
Judge Pauline Newman will speak at a panel discussion titled "Are the Supreme Court and Federal Circuit on the Same
Page for Patent Law?" The Chief Judge will also give the luncheon address on Thursday, April 10, 2008. He will discuss concerns from
the bench on pending patent reform legislation. Also on Thursday, April 10, 2008, Judge Richard Linn will participate in a panel
discussion titled "2021: A Patent Odyssey - Where Will Patent Reform Ultimately Take Us." Chief Judge Michel will also participate
in the patent law panel of the session titled "Breaking News - Hot Topics in Copyright, Trademark and Patent Law" on
Saturday, April 12, 2008. On Friday, April 11, 2008, Chief Circuit Mediator James Amend and Circuit Mediation Officer Wendy Dean will present a program on the court's mediation program.

Federal Circuit Announces Rules Changes Effective December 1, 2007
The Court of Appeals for the Federal Circuit has issued a Dear Reader Letter regarding changes to the court's rules.
Effective December 1, 2007, Federal Rule of Appellate Procedure 25 has been amended.View the amended rule here.
Incorporated into the notice at page two is a correction to Federal Circuit
Rule 28(e), revised to eliminate the requirement to include in briefs parallel citations to United States Patents Quarterly.

Now Available
Oral argument tapes
and copies of final opinions are still available from the court's Administrative Services Office.
Final opinions and audio recordings of oral arguments, however, are available for free on the court's website.
Opinions are available the day they are released. Oral arguments are available within 24 hours of when
the argument is heard. Any questions may be referred to Mr. Ronald McGruder at 202-312-3467.

Celebrating the 25th Anniversary of the Federal Circuit on April 2, 2007
The United States Court of Appeals for the Federal Circuit held a special session
of the court on April 2, 2007 to celebrate the 25th anniversary of the signing
of the Federal Courts Improvement Act of 1982, the law which created the court.
Chief Judge Michel presided, with all the active and senior members of the court
joining him on the bench, and over 350 others in attendance. In his opening remarks,
Chief Judge Michel welcomed judges from the United States District Court for the District
of Columbia, the United States Court of Federal Claims, the United States Court of Appeals for
Veterans Claims, and the United States Court of Appeals for the Armed Forces. Chief Judge Michel
also recognized the Honorable Robert Kastenmeier, former chair of the House Judiciary Committee
and sponsor in the House of Representatives of the bill that created the Federal Circuit.
Leaders of the Federal Circuit Bar Association and the Federal Circuit Historical Society,
co-sponsors of the event, also were introduced. Four preeminent members of the bar discussed the
original purpose of the legislation and the success of the Federal Circuit in achieving its stated
purpose. Fred H. Fielding, White House Counsel, who served as Counsel to the President for
President Ronald Reagan, and was present at the Rose Garden ceremony on April 2, 1982
when President Reagan signed the bill into law, was the first to speak. He was followed by
Daniel J. Meador, the James Monroe Professor of Law Emeritus at the University of Virginia
School of Law, who was also present at the signing in 1982. Professor Meador is known to
many as the "father" of the Federal Circuit, for his role is developing the idea of creating
the Federal Circuit during his tenure at the Department of Justice as Assistant Attorney General
in the Office for Improvements in the Administration of Justice from 1977 to 1979. Donald R. Dunner,
partner in the firm Finnegan, Henderson, Farabow, Garrett and Dunner, and author of a two-volume
treatise titled Federal Circuit Practice and Procedure followed Professor Meador. As a leading member
of the patent bar, Mr. Dunner played an important role in support of the creation of the Federal Circuit,
testifying at the hearings that were held on the bill to create the Federal Circuit. Finally,
Senior Judge Daniel M. Friedman of the Federal Circuit, who is the lone surviving member of the
original court as it was constituted in 1982, and who was also present at the Rose Garden signing ceremony,
discussed the creation of the court from the perspective of his position as Chief Judge of the
Court of Claims, one of the two predecessor courts of the Federal Circuit. A reception was held in the
Dolley Madison House immediately following the special session.
