Buy America Act

The following information was transmitted to Congress on behalf of the Foundation for FY 2006:

Dear Senator Feingold:

Section 641 of Public Law 108-447, the Consolidated Appropriations Act, 2005, provides the annual reporting requirements for the Buy American Act and requires each Federal agency to submit a report to Congress on the amount of acquisitions made by the agency from entities that manufacture the articles, materials, or supplies outside of the United States in that fiscal year.

The Harry S. Truman Scholarship Foundation provides the following information for FY 2006:

  1. Provide the dollar value of any articles, materials, or supplies purchased that were manufactured outside of the United States:

    Response: The Harry S. Truman Scholarship Foundation made $81.98 in purchases of articles, materials, or supplies manufactured outside of the United States within the meaning of the Buy American Act.

  2. Provide an itemized list of all waivers granted with respect to such articles, materials, or supplies under the Buy American Act (41 U.S.C. 10a et seq.);

    Response: All $81.98 of purchases in response to Question #1 were made both pursuant to the micro-purchase threshold of 41 U.S.C. §428 (f) and §517 of Public Law 108-447, which exempts commercial information technology from restrictions of the Buy American Act.

  3. Provide a summary of the total procurement funds spent on goods manufactured in the United States versus funds spent on goods manufactured outside of the United States.

    Response: The Harry S. Truman Scholarship Foundation spent $6535.01 on goods manufactured in the United States. As stated in Question #1, the Foundation spent $81.98 on goods manufactured outside of the United States.

Fair Act Inventory

Pursuant to Section 840 of the FY 2006 Transportation, Treasury, Housing and Urban Development, the Judiciary, the District of Columbia, and Independent Agencies Approrpiations Act (P.L. 109-115), the Harry S. Truman Scholarship Foundation is no longer required to file a Fair Act Inventory. 

The following is the information sent to the EOP regarding the Harry S. Truman Scholarship Foundation's Fair Act Inventory for 2005.

The Foundation has reviewed the Federal Activities Inventory Reform Act of 1988, and has determined that all of the current activities performed by the Foundation's employees are inherently governmental. In addition, many of the functions meeting the criteria outlined are being performed for the Foundation by other Federal agencies, including payroll, personnel, accounting, budgeting and debt collection. Moreover, in order to maximize the resources available to the Foundation, we have utilized commercial, contract support versus full time (FTE) employees to provide a wide range of products and services to our employees, institutions and the public including printing of our nomination materials, educational services and computer hardware and software support.

Because inherently government functions are exempt, the Harry S. Truman Scholarship Foundation does not have any remaining commercial activities to report at this time.
