TO: STATE AND TRIBAL AGENCIES ADMINISTERING CHILD SUPPORT ENFORCEMENT PLANS UNDER TITLE IV-D OF THE SOCIAL SECURITY ACT AND OTHER INTERESTED INDIVIDUALS

SUBJECT: ISSUANCE FROM THE FOOD STAMP AGENCY

BACKGROUND: The NPRM implementing provisions of Title IV-D of the Social Security Act as amended by the Deficit Reduction Act of 2005 was published in the Federal Register on January 24, 2007 (72 FR 3093). Questions concerning the impact of the requirement for cooperation with the IV-D program as a condition of receipt of eligibility for the Food Stamp program were raised during the comment period. Those comments will be addressed in the final regulation.

The purpose of this IM is to share with you an issuance distributed by the Food Stamp agency on August 22, 2007. The guidance concerns the collection of fees for the child support enforcement program when there is an issue in interpreting specific provisions of the Food Stamp Act. This guidance specifically addresses individual food stamp recipients who have never received Temporary Assistance for Needy Families (TANF) or Aid to Families with Dependent Children (AFDC). The Food Stamp program worked with OCE in developing its guidance. This guidance reflects both agencies view of the appropriate methods of collection of the $25 fee when Food Stamp recipients are required to cooperate with child support enforcement.
