This is the determination of the Railroad Retirement
Board concerning the continuing status of the St. Lawrence & Raquette
River Railroad, Inc. (SL&RR), B.A. No. 3283, as an employer under the
Railroad Retirement Act (45 U.S.C. § 231, et seq.) (RRA) and the Railroad
Unemployment Insurance Act (45 U.S.C. § 351, et seq.) (RUIA). SL&RR was
ruled to be an employer under the RRA and RUIA effective June 6, 1990.
According to Ms. Linda M. Dingman, Vice President of SL&RR, the railroad
ceased all operations on September 14, 1998, and last compensated its
employees on September 16, 1998. All service on the line formerly operated
by SL&RR has been taken over by the New York & Ogdensburg Railway, B.A.
No. 2272. Although SL&RR has not been formally dissolved as a corporation,
Ms. Dingman has advised that it has sold its equipment.
In view of the foregoing, it is the determination of the Railroad
Retirement Board that the St. Lawrence & Raquette River Railroad, Inc.
ceased being an employer under the RRA and RUIA effective September 16,
1998, the date as of which it last compensated employees. |
