EPA Finalizes Clean Air Plan for Four Corners Power Plant

April 30, 2007: Final action on Source-specific Federal Implementation Plan for Four Corners Power Plant

EPA finalized a Federal Implementation Plan (FIP) under the Clean Air Act (CAA) to regulate emissions from the Four Corners Power Plant (FCPP), located on the Navajo Indian Reservation in New Mexico. The purpose of this FIP is to ensure protection of tribal air resources. The plant previously followed emissions limits in the New Mexico State Implementation Plan. However, EPA’s promulgation of the Tribal Authority Rule clarified that State air quality regulations generally could not be extended to facilities located on the reservation. This FIP establishes federally enforceable emissions limitations for sulfur dioxide, nitrogen oxides, total particulate matter, and opacity, and a requirement for control measures for dust. The plan includes significant sulfur dioxide reductions from the facility's historic highs at the 5-unit 2,040 megawatt Four Corners plant, which began operations in 1962. The reductions are the result of a partnership between the Navajo Nation, the Arizona Public Service, the National Park Service, Environmental Defense, Western Resource Advocates, and New Mexico Citizens for Clean Air and Water.

Upcoming Actions

EPA has opened a docket  Exiting EPA (disclaimer)regarding the implementation of the Regional Haze Rule in the Navajo Nation. In order to evaluate whether we should develop a Federal Implementation Plan pursuant to our authority under the Clean Air Act and the Tribal Authority Rule, Region IX has requested that certain sources operating in the Navajo Nation provide an analysis of the Best Available Retrofit Technology (BART) applicable to their emission units, and we have initiated consultation with potentially impacted States regarding these analyses. This docket is provided for information-sharing purposes, and any final action to implement the Regional Haze Rule for the Navajo Nation would only be made after the publication in the Federal Register of a proposal, the solicitation of public comment, the publication of a response to comments, and additional consultation with impacted States and the Federal Land Managers of potentially impacted Class I areas. Additional documents that are relied upon in any future rulemaking on this topic will be added to this docket as they are generated or received.

EPA is proposing Federal Implementation Plans (FIPs) under the Clean Air Act (CAA) to regulate emissions from the Navajo Generating Station (NGS) and the Four Corners Power Plant (FCPP), located on the Navajo Indian Reservation in Arizona and New Mexico, respectively. The purpose of these FIPs is to ensure protection of tribal air resources. The plants were previously complying with emissions limits in the Arizona and New Mexico State Implementation Plans. However, EPA’s promulgation of the Tribal Authority Rule clarified that State air quality regulations generally could not be extended to facilities located on the reservation. These FIPs propose to establish federally enforceable emissions limitations for sulfur dioxide, nitrogen oxides, total particulate matter, and opacity, and a requirement for control measures for dust.
