California New Source Review

Call for Revision to California State Law

EPA took final action on June 25, 2003, to require that California remove the agricultural permitting exemption from state law for the new source review permitting program for major stationary emissions sources. These permits require appropriate pollution controls and pollution credits to offset pollution increases at new or modified stationary sources.

EPA proposed to remove the agricultural exemption from the state’s new source review program in February, 2003. EPA received no public comments on this proposal. This final action gives the state until November 18, 2003, to change state law and avoid starting a timetable for sanctions under the Clean air Act.
