Occupancy And Use

Pursuant to 36 CFR 261.50(a) and (b), and for public health and safety, the following acts are prohibited within the Mendocino National Forest (including Lake Red Bluff Area), which is under my jurisdiction:.

  1. Discharging a firearm, air rifle, or gas gun during the night time hours between one-half hour after sunset to one-half before sunrise. 36 CFR 261.58(m).
  2. Shooting in violation of any sign posted for public safety reasons. 36 CFR 261.58(m).
  3. Discharging steel core or armor piercing ammunition. 36 CFR 261.58(m).

Pursuant to 36 CFR 261.50(e), each of the following persons are exempt from this order:

  1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
  2. Any Federal, State or local officer, or member of an organized rescue or fire fighting force in the performance of an official duty.

This prohibition is in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

A violation of this prohibition is punishable by a fine of not more that $5,000.00 for an individual or $10,000 for an organization, or imprisonment for not more than six months, or both. 16 USC 551 and 18 USC 3559, 3571, and 3581.
