205.9 - Authority to Approve Requests to Testify, and Release of Official Personnel Folders

1. Court Testimony and Release of Official Records. The authority to grant or deny requests or subpoenas for U.S. Geological Survey (USGS) employees to testify, give depositions, or release official records rests with the Solicitor (209 DM 3.2A(8)). This authority is delegated to the Director in 43 CFR Part 2.89. For headquarters offices, this authority is redelegated to the Deputy Ethics Counselor. Within the regions, this authority is redelegated to Chiefs, Offices of Regional Services. All requests and subpoenas require consultation with the applicable unit of the Solicitor's Office.

2. Official Personnel Folders. The authority to release Official Personnel Folders upon receipt of a subpoena is delegated to the Personnel Officer holding the record

3. Requirements. Authorities will be exercised in accordance with the provisions of 43 CFR 2.80 - 2.90 and SM 450.2.
