BACKGROUND
On October 30, 2000, Congress signed Public Law 106-393. This
law is called the "Secure Rural School and Community Self-Determination
Act of 2000" and is commonly known as "Payments to Counties." (From 10/30/2001 to 9/30/2006)
Recognizing that revenue from timber harvest has been sharply
curtailed during recent years, the Law addresses funds received
on Federal land, which have historically been shared with counties
and been used for schools and roads.
ONE-YEAR-REAUTHORIZATION FOR FISCAL YEAR 2007
A one-year reauthorization of this Act (under Section 5401 of the Iraq Accountability Appropriations Act of 2007) provided for a one year measure of payments, at the Fiscal Year 2007 level. (From 5/30/2007 to 9/30/2007)
REAUTHORIZATION FOR FISCAL YEARS 2008-2011
On October 3, 2008, the Secure Rural Schools and Community Self-Determination Act of 2000 was reauthorized as part of Public Law 110-343. The Secure Rural Schools and Community Self-Determination Act of 2000 was reauthorized for an additional four years as (under Emergency Economic Stabilization Act of 2008, Energy Improvement and Extension Act of 2008 and Tax Extenders and Alternate Minimum Tax Relief Act of 2008) (From 10/03/2008 to 10/03/2010.)
The authority to initiate Title II projects terminates on September 30, 2011. Funds that are not obligated by September 30, 2012, must be transferred to the Treasury.
COUNTIES ALLOCATE PROJECTED PAYMENTS FOR TITLE II FUNDS
The law allows counties to receive a payment from the Federal government based on the average of their top three years (1986-1999) of payments from Federal lands (referred to as the "full payment amount").
The new Secure Rural Schools Act has some significant changes. The Forest Service previously requested states and counties to elect to receive a share of the 25-percent rolling average payment or a share of the Secure Rural Schools State (formula) payment by November 14, 2008 (county elections). A county electing to receive a share of the State payment also was requested to allocate between 15 to 20-percent of its share for one or more of the following purposes: projects under Title II of the Act; projects under Title III; or the Treasury of the United States (county allocations).
This legislation authorizes the Resource Advisory Committees to recommend funding on Title II projects or natural resource management projects that improve and/or enhance the Rogue River-Siskiyou National Forest.
