CARBAZOLE VIOLET PIGMENT 23 FROM CHINA AND INDIA INJURES U.S. INDUSTRY, SAYS ITC

The United States International Trade Commission (ITC) today determined that a U.S. industry is materially injured by reason of imports of carbazole violet pigment 23 from India that the U.S. Department of Commerce has determined are subsidized and imports from China and India that Commerce has determined are sold in the United States at less than fair value.

All six Commissioners voted in the affirmative.

As a result of the Commission's affirmative determinations, the U.S. Department of Commerce will issue an antidumping order on imports of this product from China and India and a countervailing duty order on imports of this product from India.

The Commerce Department previously made an affirmative critical circumstances determination with regard to imports of this product from two Chinese firms. All six Commissioners made negative determinations with regard to critical circumstances in this investigation. As a result, the antidumping duty order concerning these imports will not apply to goods that entered the United States from China prior to June 24, 2004, the date of the Department of Commerce's affirmative preliminary determination.

Product Description:
The product covered by these investigations is carbazole violet pigment 23 identified as Color Index No. 51319 and Chemical Abstracts Service Registry No. 6358-30-1, with the chemical name of diindolo-[3,2-b:3',2'-m]triphenodioxazine, 8, 18-dichloro-5, 15-diethyl-5,15-dihydro-, and molecular formula of C34H22C12N4O2. The subject merchandise includes the crude pigment in any form (e.g., dry powder, paste, wet cake) and finished pigment in the form of presscake and dry color. The merchandise subject to these investigations is provided for in subheading 3204.17.90 of the Harmonized Tariff Schedule of the United States (HTS).
