Dear Sir or Madam:

The following letter is intended to address the points raised by Mr. Robert Carroll in his complaint against IP & R Inventor’s Publishing & Research, LLC (IP&R) dated June 15, 2007, and attached hereto.

IP&R must stress the overriding fact that Mr. Carroll is not, and never has been, a client of IP &R. Therefore, it seems Mr. Carroll’s sole complaint is that IP&R has not returned his prototype.

IP&R’s first communication with Mr. Carroll came in April of 2005, but he did not become a client. Apparently hoping to convince IP&R to market his invention without a fee, Mr. Carroll sent as unsolicited prototype to IP&R’s office. When the prototype arrived at IP&R, a representative attempted to contact him. IP&R was informed that Mr. Carroll was unavailable and that he would be overseas for two weeks. Over two months later, IP&R was finally able to speak to Mr. Carroll, but he still did become a client. Mr. Carroll did not request return of his prototype and did not contact IP&R again until September 2006. At that time, Mr. Carroll wanted to see if IP&R would sell his patent, but he still did not sign on as a client. Another 2 months passed before IP&R heard from Mr. Carroll again. It was at this point he first asked IP&R to return his prototype.

Due to the unsolicited nature of the submission from a non-client and the inconsistent communication over more than a year and a half, his file and relevant materials were sent to storage offsite. Since IP&R first received Mr. Carroll’s request, its personnel have searched the offices and storage, but have not been able to locate his prototype. IP&R is sorry that the prototype is lost, but we continue to see if it turns up. If we do locate prototype, we will promptly contact Mr. Carroll and will ship it back to him at our expense.

We thank the Patent and Trademark Office for bringing Mr. Carroll’s complaint to our attention. We trust this letter adequately responds to it. Please do not hesitate to contact me directly should you or Mr. Carroll have any further questions or comments in connection with this matter.
