MEMORANDUM

TO: Designated Agency Ethics Officials

FROM: Stephen D. Potts Director

SUBJECT: Annual Agency Ethics Program Questionnaire


Please complete and return the attached ethics program questionnaire to the Office of Government Ethics (OGE) by February 1, 1995. Your response to this questionnaire will constitute your annual report for 1994 as required by section 402(e)(1) of the Ethics in Government Act of 1978, as amended.

This year you have the option of submitting the questionnaire electronically via diskette. For further details, please contact Jennifer Kang in OGE's Office of Education at (202) 523-5757, extension 1111.

Please note, the length and the content of the 1994 questionnaire differ somewhat from the previous year. Most notably, OGE shortened five sections:

. AGENCY AUTHORITY; . ETHICS OPINIONS, ADVICE, AND COUNSELING; . PUBLIC FINANCIAL DISCLOSURE; . CONFIDENTIAL FINANCIAL DISCLOSURE; and . WAIVERS.

Conversely, because ethics officials are interested in more economical and efficient methods by which other agencies manage their ethics programs, OGE added two new questions under the RESOURCES section.

In light of agency comments, OGE decided not to make the revisions to the 1994 questionnaire cited in our October 18, 1993 memorandum.

In addition to providing the 1994 questionnaire, this memorandum serves as an advance notice of changes to the 1995 questionnaire. In the 1995 questionnaire, we expect to revise the EDUCATION AND TRAINING section by including these questions:

. How many covered special Government employees received annual ethics training by means of written materials under the exception at 5 C.F.R. § 2638.704(d)(2)(ii)? ______

. How many covered officers in the uniformed services who serve on active duty for 30 or fewer consecutive days received annual ethics training by means of written materials under the exception at 5 C.F.R. § 2638.704(d)(2)(iii)? ______

Agencies should take note of these upcoming changes and, if necessary, modify their data collection methods for calendar year 1995.

Remember, the questionnaire covers the period January 1, 1994 through December 31, 1994 and failure to file on or before February 1, 1995, may be cause for OGE to invoke its corrective action authority (5 C.F.R. § 2638.602(b)). Please note that the information contained in the questionnaire is subject to the Freedom of Information Act. All completed questionnaires should be submitted directly to Jennifer Kang.
