Abstract: EPA has completed its reconsideration of certain regulatory definitions that determine the type of sources subject to EPA's new source performance standards and emission guidelines for commercial and industrial solid waste incineration (CISWI) units under section 129 of the CAA. EPA is promulgating revised definitions for the terms "solid waste," "commercial or industrial waste," and "commercial and industrial solid waste incineration unit," consistent with EPA's February 2004 reconsideration proposal in that EPA will continue to identify CISWI units based on whether such units combust waste without energy recovery. However, the revised definitions being promulgated do not include certain regulatory language proposed in February 2004 to include units with only waste heat recovery in the CISWI source category. In a subsequent rulemaking action, EPA intends to propose additional regulatory language to address units with only waste heat recovery and assess the impacts of the inclusion of these units in the CISWI source category. As a result of our action on the CISWI definitions, it is not necessary to make any corresponding revisions to the NESHAP for Industrial, Commercial, and Institutional Boilers and Process Heaters.
