The following is an update from the Superfund, TRI, EPCRA, RMP & Oil Program Information Center:
On April 9, 2009, EPA added the following nine sites to the NPL, bringing the total number of final sites on the list to 1,264 (74 FR 16126):

April 01, 2009 - SPCC Amendments
The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:
On April 1, 2009, EPA published a final rule to further delay the effective date of the December 5, 2008, amendments to the SPCC Regulations, in accordance with the memorandum from the Office of Management and Budget entitled, "Implementation of Memorandum Concerning Regulatory Review" (M-09-08, January 21, 2009). The amendments will now become effective on January 14, 2010. Additionally, EPA is requesting public comment on whether a further delay of the effective date may be warranted.
It is important to note that this rule does not change the compliance dates by which owners or operators of facilities must prepare or amend their SPCC Plans and implement those Plans in accordance with the 2002 SPCC Rule. However, EPA intends to address these dates in a separate notice. Until that time, the current compliance date for the SPCC rule is July 1, 2009, for all facilities other than farms. Farms must prepare or amend and implement an SPCC Plan when EPA establishes by rule a compliance date for farms.
The December 5, 2008, amendments to the SPCC Rule clarified regulatory requirements, tailored requirements to particular industry sectors, and streamlined certain requirements for facility owners or operators subject to the rule. With these changes, EPA expects to encourage greater compliance with the SPCC regulations, thus resulting in increased protection of human health and the environment.
The amendments did not remove any regulatory requirement for owners or operators of facilities in operation before August 16, 2002, to develop, implement, and maintain an SPCC Plan in accordance with the SPCC Regulations then in effect. Such facilities are still required to maintain their plans during the interim until the applicable date for revising and implementing their plans under the new amendments.

March 19, 2009 - 2007 TRI Reporting Data
The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:
On March 19, 2009, EPA made available the most recent reporting data from the Toxics Release Inventory (TRI) Program. The Reporting Year 2007 (RY07) TRI public data release (PDR) included information on the combined releases of four billion pounds from approximately 22,000 facilities. TRI's 2007 PDR includes a brochure with a quick overview of the 2007 data with a general comparison to previous years' trends, as well as a detailed report outlining the key findings.

December 17, 2008 - Freshwater Spills Symposium
EPA is pleased to host the seventh Freshwater Spills Symposium (FSS) in St. Louis, Missouri, on April 27-30, 2009. The FSS is aimed at local, state, federal, and industry responders, natural resource trustees and managers, facility response planners, and other stakeholders to promote sharing of information to better understand the challenges posed by oil spills in freshwater environments. This year EPA will be offering free short courses on Monday April 27, 2009. The Symposium will follow on Tuesday, April 28, 2009, through Thursday, April 30, 2009. The FSS Announcement and Call for Papers are currently available on the FSS Web site, and as additional details such as accommodations, agenda, and registration are finalized, EPA will post the information to the FSS Web site.

November 20, 2008 - Amendments to the SPCC Rule
The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:
On November 20, 2008, the EPA Administrator signed amendments to the SPCC Rule to clarify regulatory requirements, tailor requirements to particular industry sectors, and streamline certain requirements for facility owners or operators subject to the Rule. With these changes, EPA expects to encourage greater compliance with the SPCC regulations, thus resulting in increased protection of human health and the environment.
The amendments do not remove any regulatory requirement for owners or operators of facilities in operation before August 16, 2002, to develop, implement and maintain an SPCC Plan in accordance with the SPCC regulations then in effect. Such facilities continue to be required to maintain their plans during the interim until the applicable date for revising and implementing their plans under the new amendments.
EPA also is announcing a proposed rule to extend the compliance dates for all facilities to November 2009 and to establish new compliance dates for farms (November 2009), certain qualified farms (November 2010), and marginal oil production facilities (November 2013) subject to SPCC. These revised compliance dates will provide owners or operators of the various kinds of facilities the opportunity to fully understand the regulatory amendments offered by revisions to the SPCC Rule from 2006 and 2008.
Finally, EPA is announcing a final rule that vacates the July 17, 2002, definition of "navigable waters" and restores the definition of "navigable waters" that EPA promulgated in 1973. This is in accordance with an order issued by the United States District Court for the District of Columbia (D.D.C) in American Petroleum Institute v. Johnson, 571 F. Supp.2d 165 (D.D.C. 2008). This final rule does not amend the definition of "navigable waters" in any other regulation that EPA has promulgated.

November 03, 2008 - Final Amendments to EPCRA Regulations
The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:
On November 3, 2008, EPA published a rule to finalize several changes to the EPCRA regulations (73 FR 65452). The final rule changed 40 CFR Parts 355 and 370 to a plain language, question and answer format. EPA also provided clarification regarding reporting hazardous chemicals and extremely hazardous substances in mixtures. As a result, the final rule re-numbered and re-organized each section in Parts 355 and 370.
Additionally, EPA removed the Tier I and Tier II reporting forms from the regulations and made minor changes to the forms. On the Tier I and Tier II form, facilities are now required to report their North American Industrial Classification (NAICS) code, instead of their Standard Industrial Classification (SIC) code, and the chemical or common name of the chemical as provided on the Material Safety Data Sheet (MSDS).

September 10, 2008 - Update to electronic-Facility Data Release (e-FDR) Query Tool for 2007 TRI Data
The following is an update from EPA's Superfund, TRI, EPCRA, RMP & Oil Information Center:
EPA has made available the electronic-Facility Data Release (e-FDR) query tool for reporting year 2007 (RY07) TRI data. This tool provides access to facility-level, form-by-form TRI data but does not include analyses of the TRI data, such as national trend analyses. These trends will be available in the spring Public Data Release after undergoing extensive data quality checks.
Three changes have occurred for the RY07 e-FDR. First, the e-mail address of the public contact was added in Part I, Section 4.4 of both the Form R and Form A. Second, two revision code boxes were added to the top of each form to indicate why the revision was made. Third, four new Basis of Estimate codes were added and two existing codes were removed in Part II, Sections 5, 6.1 and 6.2 of the Form R to indicate the principal method that was used to determine a reported quantity.
