May 28, 2004 - United States Attorney Patrick L. Meehan today announced the filing of an Information* charging Kwang H. Lee with one count of willfully subscribing to a false income tax return, in violation of 26 U.S.C. § 7206(1). According to the information, defendant Lee signed and filed a federal income tax return (Form 1040) that falsely understated his actual income by approximately $103,155 for the tax year 2001. Specifically, it is alleged that Lee reported income of only $94,281 when, as he knew, his income was approximately $197,436.
If convicted, the defendant faces a maximum possible sentence of 3 years in prison, one year of supervised release, a fine of $100,000, and a special assessment of $100.
The case was investigated by the Internal Revenue Service's Criminal Investigative Division. The case has been assigned to Assistant United States Attorney John J. Pease.
